Guardianship (care) of the child in an institution

A child without parental care can only be placed in a children care institution in exceptional cases, when it is not possible to care for him/her in a family, a care centre or a foster family.

A child under the age of three can be placed in a children’s care institution only in exceptional cases, with the approval of the state authority for the protection of children’s rights.

The State Child Rights Protection Authority approves the fostering of a child under the age of three in a children’s care institution only in exceptional cases, if at least one of the following reasons has been established:

1) the child needs specialised health care and/or nursing services that cannot be provided by the child’s placement in a family, foster care centre or foster family;

2) separating the child from his/her siblings would be contrary to his/her best interests;

3) the guardianship is established because of the urgent removal of the child from his/her legal representatives and it is not possible to place the child in the care of a family, a foster care centre or a foster family.

A child under the age of three can be placed in a children’s care institution for up to three months.
