A child may be adopted by persons whose permanent place of residence is in a foreign state, citizens of a foreign state and stateless persons whose permanent place of residence is in the Republic of Lithuania, if within 6 months from the date of inclusion of the child in the list of children available for adoption, no family that is a citizen of the Republic of Lithuania living in Lithuania has been found and is capable of fostering or adopting this child.
When proposing a child for adoption, the child’s upbringing heredity, ethnic origin, cultural affiliation and mother tongue are taken into account; therefore, preference for adoption is given to citizens of the Republic of Lithuania living abroad, as well as to citizens of foreign countries with Lithuanian origin. A person of Lithuanian descent is defined as a person whose parents or grandparents, or one of their parents or grandparents, are or have been Lithuanians, and the person recognises himself or herself as Lithuanian.
