Step one. When can I adopt?

In order to adopt your spouse’s child, the child must be available for adoption:

- The child’s biological parent (to be entered on the child’s birth certificate) has confirmed to the court that he/she agrees to adopt the child;

- The father/mother is unknown, dead or declared dead;

- The father/mother is given indefinite custody of the child.
